Article 1 Definitions
In these general travel conditions the following terms have the following meaning:
1.1 Travel organizer: Atlas AirTour B.V.
1.2 Travel Agreement: the agreement that is concluded at the moment that the Travel Organizer’s order issued by the Traveler is received, as a result of which the Travel Organizer undertakes towards the Traveler to provide a previously organized trip.
1.3 Traveler: the party with whom the Travel Organizer has concluded a Travel Agreement, which is subject to the General Travel Conditions.
1.4 Travel sum: the total amount of the trip, including any surcharges, taxes and booking fees.
1.5 Travel Proposal: a travel plan including travel sum to be provided by the Travel Organizer to provide the Traveler with an organized trip, under the General Travel Terms and Conditions applicable to the Travel Mediator.
Article 2 Establishment of the Travel Agreement
The agreement is concluded by the booking or acceptance by the Traveler of the Travel Proposal of Travel Organizer. The person who books a trip for other participants is jointly and severally liable for all others that he / she registers. When registering a minor, written permission from the legal representative is required.
Article 3 Reservation, Travel Agreement and confirmation
3.1. When confirming the journey, the Traveler must be able to provide the details from the passport. It is important to mention the first official first name, the surname (in the case of married ladies, their own family name) and the birth name, as mentioned in the passport. The travel proposals made by Travel Organizer are without obligation; they are valid for 14 days, unless otherwise indicated.
3.2 Reservation of the trip takes place via the website or by e-mail by confirmation of the Travel Agreement, including a copy of the passport of the Travelers.
3.3 The traveler then receives a booking confirmation with invoice. A reservation for a trip is only definitive when the amount of the deposit has been received by “Travel Organizer”. or in the case of STO Reisgarantie that the deposit has been received by the third party account.
3.4 The Travel Organizer’s offer may be revoked if necessary. This also applies to mistakes or errors in the offer. Revocation is possible up to 24 hours after the date of confirmation by the Travel Organizer and with a statement of reasons.
3.5 Travel Organizer has the right to increase the Travel Sum up to 20 days before the day of departure due to changes in fuel prices or exchange rates.
Article 4. Invoicing and payment
4.0 The STO travel guarantee applies to all package holidays and payment is made via the Certo Escrow payment service.
4.1 The down payment for the trip is at least 50% of the total travel sum and is handled by Certo Escrow for package travel.
4.2 No later than six weeks before the day of departure, Passenger must pay the remainder of the Travel Sum in order to continue the journey of the relevant Traveler or fellow travelers.
4.4 In case of overdue payment, the Traveler is in default. A payment reminder will follow and if the payment is not paid within 7 working days, the agreement will be considered canceled and cancellation fees will be charged.
4.5 For bookings where the trip will take place within or less than 8 weeks, Reisorganisator Reiziger asks the entire Reissom to pay immediately.
Article 5 Liability
5.1 Travel Organizer undertakes, with regard to the execution of the Travel Agreement, in accordance with the expectations that the Traveler could reasonably have on the basis of the confirmed Travel Proposal.
5.1 The Traveler and / or his / her fellow traveler (s) must take care of a travel and / or cancellation insurance.
5.2 Traveler acknowledges that Travel Organizer can under no circumstances be held liable with regard to the execution of the agreed Travel Agreement.
5.3 Travel Organizer is not liable insofar as the Traveler is able to claim his / her damage under an insurance policy, such as a travel and / or holiday cancellation insurance.
5.4 Other liability is limited to the amount of the invoiced Travel sum to Traveler.
Article 6 Travel guarantee
6.1 Travel Organizer takes the necessary measures to ensure that, if he can not or can not continue to fulfill his obligations towards Passenger due to financial inability, he is taken care of either to take over his obligations by another party or to refund the fare or, if the journey already partially enjoyed, a proportionate share thereof. If the traveler has already arrived at the place of destination, the travel agreement must in any case be provided for the return journey insofar as the travel agreement includes that transport.
6.2 In order to comply with the legal guarantee obligation in these cases, Travel Organizer offers the STO travel guarantee. The Take Over (STO) Foundation will, in the event of an unexpected bankruptcy of Reisorganisator, get access to the fare and ensure that Passenger gets his or her money back, can continue the journey or return home. If the STO guarantee applies, this will be explicitly stated in the Travel Agreement.
Article 7 Cancellation by Traveler
7.1 If an agreement is canceled by the Traveler, the travel organizer may charge the traveler the following cancellation costs in addition to any reservation costs that may be due:
– in case of cancellation up to the 42nd calendar day (exclusive) before the day of departure: 10% of the travel sum;
– cancellation from the 42nd calendar day (inclusive) up to the 28th day (exclusive) before the day of departure: 35% of the travel sum;
– in case of cancellation from the 28th calendar day (inclusive) up to the 21st day (exclusive) before the departure date: 40% of the travel sum;
– in case of cancellation from the 21st calendar day (inclusive) up to the 14th day (exclusive) before the departure day: 50% of the travel sum;
– in case of cancellation from the 14th calendar day (inclusive) up to the 5th day (exclusive) before the day of departure: 75% of the travel sum;
– in case of cancellation from the 5th calendar day (inclusive) until the day of departure: 90% of the travel sum;
– in case of cancellation on the day of departure or later: the full travel sum.
Article 8 Complaints handling
8.1 A shortcoming in the execution of the Travel Agreement must be reported to Reisorganisatie as soon as possible, preferably during the trip , so that it can find a suitable solution. If a shortcoming is not satisfactorily resolved, it must be submitted to Reisorganisatie at the latest within one month after returning to the Netherlands. Traveler will receive a substantive response within 2 weeks.
